Legal and Notices

The owner/operator ("MERCHANT") of this public Internet Web site ("WEB STORE") is not liable for the failure of any single electronic commerce transaction or any series of electronic commerce transaction authorization failures experienced by one or more end-users accessing this WEB STORE over any public or private telecommunication system. Under no circumstances, including negligence, shall MERCHANT be liable for any incidental, special or consequential damages that result from the access or inability to access the WEB STORE. Similarly, MERCHANT shall not be liable for the failure of delivery of any product or service purchased by one or more end-users accessing this WEBSTORE through any public or private telecommunication system due to errors, omissions, interruptions, delays in operation, system congestion, insufficient bandwidth or any other failure of performance whether or not caused by events beyond MERCHANT'S reasonable control. These include but are not limited to, acts of God, theft, destruction, or unauthorized use of the public Internet by any unknown third party directly or indirectly affecting the WEB STORE. In any case, the MERCHANT'S entire liability and CUSTOMER'S exclusive remedy will be defined by the terms of the Merchant Account Agreement under which payment was made for any product or service purchased at the WEB STORE. 

Dan's Racing Supply Company Policies

PAYMENT - Orders must be prepaid by Visa or MasterCard.  We hope to add  American Express and Discover in the near future. Cash will be accepted in store only.  Personal Checks accepted (see policy below).  No Company Checks without prior authorization.

Personal Checks - To pay by personal check, place your order online, select Personal Check on the order screen, and follow these instructions: Make your check or money order payable to Dan's Racing Supply in the amount listed on the Order page. This amount includes shipping & tax. Include your Customer ID Number on the check so that we can process your order correctly and without delay. Send your check to the address listed on the Check Out Page. When you pay by check, please allow up to 30 days to receive your order.

SHIPPING - We ship UPS daily. All prices FOB Mesa, Arizona. Call by 1:00 PM Mountain time to insure same day shipping. Backorders will be held 10 days. Priority available. Overnight and 2nd day shipping available on credit card orders. Call for details.

RETURNS - No returns will be accepted without a return authorization (R.A. Number). Any returns after 90 days will not receive credit for materials. No returns on special order items. No refunds without proof of purchase. All dealer returns are subject to a 15% restocking fee. Customer is responsible for any and all freight charges on packages undeliverable.

WARRANTY - Purchasers understand and recognize that racing parts and equipment and all parts, inventory and services manufactured and/or sold by Dan's Racing Supply are exposed to many and varied conditions due to the manner in which they are installed and used. Purchasers and Dan's Racing Supply consciously desire to make their own bargain, irrespective of any court decision, and purchasers agree upon good faith and in consideration for being allowed to purchase from Dan's Racing Supply said parts or services. Purchasers expressly acknowledge and understand that Dan's Racing Supply does not make any affirmation of fact or promise to purchasers which relates to said parts, inventory, or services that becomes part of the basis of the bargain with purchasers. Nor does Dan's Racing Supply make, or cause to be made, as a part of the basis of the bargain with purchasers any description or affirmation of fact concerning any sample or model of racing parts, and equipment inventory or service.

As further consideration for purchasers using Dan's Racing Supply racing parts and equipment any and all inventory and services, purchasers acknowledge that due to the differing conditions and circumstances under which all equipment and parts are installed and used, purchasers are not relying on Dan's Racing Supply skill or judgment to select or furnish the proper part or equipment. Purchasers expressly affirm that they are relying upon their own skill or judgment to select and purchase suitable goods.

Dan's Racing Supply makes no warranties whatsoever, expressed or implied, oral or written, to purchasers. There is no warranty of merchantability made to purchases. Dan's Racing Supply further exclude any implied warranty of fitness with respect to racing and equipment, any and all inventory, and service.
Purchasers take sole responsibility in the determination of the suitability of any parts, equipment or services purchased from Dan's Racing Supply, including the legality of using said parts, equipment or services in vehicles licensed for and used or driven on public provided streets and highways.

It is expressly understood and agreed between purchasers and Dan's Racing Supply that as part of the bargain between Dan's Racing Supply and purchasers, and in consideration of doing business with each other, all purchasers take, select and purchase said racing parts, equipment, any and all inventory, or services from Dan's Racing Supply "as is" and with "all faults" and Dan's Racing Supply shall always provide purchaser with a full and complete opportunity to examine, at purchasers' leisure and convenience, any racing parts, and equipment, any and all inventory or services when purchaser contemplates purchasing from Dan's Racing Supply.

If, and in the event that purchaser expressly or implied cause representation, or statements or affirmations of fact contrary to this disclaimer of all warranties, expressed or implied, than purchaser agrees to indemnify and hold harmless Dan's Racing Supply by any purchaser.

Purchasers understand and agree that no officer, director, employee, or salesman of Dan's Racing Supply has any authority to make any statements contrary to the terms of this agreement. On the contrary, Dan's Racing Supply disavows any statement contrary to what is herein above written.
